All Select Representative Completed Projects

The following brief descriptions are select completed past projects and contain details about the efforts performed by Mr. Tidemann in connection with the project.

Hartford Insurance, through outside legal counsel Jones, Skelton & Hochuli, Phoenix, AZ

Served as representative of insurance company as its appointed Appraiser in policy-mandated dispute resolution process involving an Appraiser from each side and a mutually agreed-upon Umpire regarding a dispute in the value of damages caused to a commercial property by a severe hail storm. Claimant requested $1.2M in damages based upon their appraiser’s report, and Mr. Tidemann determined entitlement to damages of approximately $223K. In formal mediation, the Umpire examined the issues and evidence and independently assessed the Actual Cash Value to be $250K, and awarded that sum to Claimant after agreed to by Mr. Tidemann.

Office of the City Attorney, City of Phoenix, Phoenix, AZ

Provided services as City of Phoenix’s Expert Witness assisting the City in its defense of a lawsuit filed by an insurance company alleging negligence on the part of the City stemming from the City’s involvement on a construction project.

Compassion First AZ

Served as Owner’s Representative and Construction Manager providing guidance, advice, and assistance with the design and construction of a first-of-its-kind facility more than six thousand square feet in size to be used for the cultivation of medical-grade marijuana. First project was followed by another facility more than seven thousand square feet in size and with characteristics unique to the application.

Financial Pacific Insurance Company, Yuma, AZ

Provided services on behalf of a Defendant being sued for $480,000 in alleged damages. Mr. Tidemann’s services were comprised primarily of research, site investigation, and report development, and culminated in trial testimony. The matter was heard and decided by a jury, and the jury found Mr. Tidemann’s calculation of damages of about $5,000 (with a deduction for depreciation to be applied) to be the most accurate and awarded the Plaintiff $3,750. Although the Plaintiff won an award of $3,750 from Mr. Tidemann’s indirect client the Defendant, since the amount of the jury award was less than the Offer of Judgment pre-trial settlement amount of $20,000, the Plaintiff became liable to reimburse the Defendant certain litigation costs, including full reimbursement for all of Mr. Tidemann’s fees for the expert services provided. Although the Plaintiff technically prevailed in its lawsuit, it ended up owing the Defendant more than $25,000.

Confidential Private Party, Vancouver, BC and Phoenix, AZ

Preformed services on behalf of the owner regarding the construction of a $50M office and housing condominium project. After project completion, Mr. Tidemann provided detailed analysis of relevant documentation submitted by contractor in support of monthly cost-reimbursable progress payment billings, and prepared reports of findings demonstrating a plethora of instances of billed “costs” that were non-compliant with the contract. Named as designated construction expert in litigation filled chiefly as a result of analyses findings; and, prepared Expert Report comprising, in part, multi-million dollar damages claimed in litigation, including increased time-related jobsite overhead, improper change orders and change order costs, and increased effort-driven jobsite general conditions costs.

Confidential Private Party, Phoenix, AZ

Provided analysis and prepared an Expert Report on behalf of a building owner and regarding a potential Lessee’s lawsuit alleging owner-responsibility for Lessee’s inability to construct its own tenant improvement work. Expert Report submitted as key evidence in owner’s Request for Summary Judgement.

Phoenix Metro Light Rail Agency, Phoenix, AZ

Provided claims review & evaluation services regarding 3 of the 5 railway line segments and the numerous segmented REAs/claims submitted by each of the three different line segment contractors. Services included analyses of alleged multi-million dollar damages and damage quantification methodologies, and involving time-related overhead, additional overhead, labor and equipment inefficiencies, and planned vs. actual production rates variances.

Colorado Department of Transportation/Colorado Office of the Attorney General, Denver, CO

Provided claims evaluation and advisory services in relation to a prime contractor claim comprised of, in part, claims being passed through from subcontractors. Initial services were provided at the project and contract administration level, and again later during research, analysis, and preparation for mediation. Issue remained unresolved administratively, and additional services were provided to the Colorado Office of the Attorney General in connection with, and preparation for, formal mediation. Mr. Tidemann developed materials for presentation in mediation proceedings by client’s legal counsel.

Catalina Foothills Unified School District, Tucson, AZ

Through the District’s outside legal counsel, provided analysis and advisory services pertaining to a new school project procured via a CM@Risk project delivery methodology. Mr. Tidemann provided the services due to numerous unsupported requests for change orders submitted by the contractor and its subcontractors throughout the course of the project. Mr. Tidemann was designated as the District’s construction expert, and a report was ultimately prepared and submitted as part of the District’s defense of a lawsuit filed by the contractor. The matter was eventually settled in court-conducted mediation in an amount overall favorable to the District.

Santa Maria–Bonita School District, Santa Maria, CA

In an aggressive program to expand and improve existing facilities and construct new school buildings ($100 million, 16 sites), the school district entered into several contracts with a contractor and associated subsidiaries for design services, manufacturing of modular buildings, building assembly and general construction as a prime contractor, and for construction management services. After two years, when the program was 75% complete, it became apparent that the contractor was not fulfilling contractual obligations and was failing to pass through to the various other prime contractors and its own subcontractors, funds it received on their behalf. Mr. Tidemann’s group sorted through the mid-program particulars of scope, schedule and cost regarding 220 individual contracts, and assisted the District’s legal counsel in defending against, and successfully negotiating, resolution of the numerous prime contractor and subcontractor claims/lawsuits without final litigation. Mr. Tidemann”s efforts effectively reduced the District’s exposure from the original $25 million estimate of damages to just over $7 million.

DG Fenn Construction, Inc. – KinderCare Learning Centers, Phoenix, AZ

Mr. Tidemann provided assistance to Contractor regarding the positioning, pricing, and negotiation of its Termination for Convenience Settlement Proposal. Subsequently provided support to contractor and its outside legal counsel in preparation and accomplishment of formal mediation regarding the additional amounts owed to the contractor because of the termination.

Salt River Project (SRP), Phoenix, AZ

Through the outside legal counsel of an insurer of Salt River Project (SRP), provided analysis regarding a worker electrocution event and how that event may have related to the project schedule and the other work of the project. The project was a new Maricopa County jail originally valued at ~$50M, and SRP was the provider of both the temporary and permanent power on the project.

Thatcher Unified School District, Thatcher, AZ

Mr. Tidemann assisted the owner and their outside legal counsel in resolving significant defective workmanship issues and schedule delays involving a newly constructed high school. He also provided support in preparing for, and taking a lead role in, settlement negotiations.

United National Insurance, Phoenix and Sedona, AZ

Mr. Tidemann conducted research and analysis regarding a dispute between a prime contractor and a subcontractor, providing support to the contractor and their outside legal counsel (for the insurance company) in efforts to identify and allocate responsibility for defective workmanship issues. He also provided deposition testimony.

Broward County Community College, Broward County, FL

Mr. Tidemann performed senior contract administration duties during the later stages of construction of a new library, and subsequently assisted with development of a comprehensive request for equitable adjustment valued at $750,000 for constructive changes, directed changes, acceleration, and delays.

City of Harvey, Harvey, ND

Mr. Tidemann provided support to the contractor’s effort to recover cost and schedule impacts incurred due to differing site conditions. He also assisted the contractor in quantifying damages and preparing for negotiation sessions between the contractor and owner.

Renovation of Army Barracks, Fort Wainwright, AK

Project owner was the US Army Corps of Engineers, and the contract was governed by the Federal Acquisition Regulation (FAR). Mr. Tidemann assisted with development of a comprehensive request for equitable adjustment valued at approximately $6 million for changes and delays. He was instrumental in the actual costs reconstruction and reclassification effort and subsequent identification/ quantification of the damages incurred. He also assisted with the research and development of individual entitlement issues.

Natches River Bridge, Houston, TX

Project owner was the Texas Department of Transportation. Mr. Tidemann assisted with the development of a comprehensive request for equitable adjustment valued at approximately $20 million for directed and constructive changes, overzealous inspection issues, delays, and acceleration.

Space Station Processing Facility, Kennedy Space Center, FL

Project owner was NASA, and the contract was governed by the Federal Acquisition Regulation (FAR). Mr. Tidemann directed development of a comprehensive request for equitable adjustment for the electrical subcontractor. The request, valued at $1 million, stemmed mainly from changes and delays arising from defective/ deficient design documents and the owner’s actions and inactions. Later, Mr. Tidemann assisted the contractor and its legal counsel with the development and presentation of a single issue in front of the Board of Contract Appeals.

Federal Detention Facility, Miami, FL

Project owner was the Federal Bureau of Prisons, and the contract was governed by the Federal Acquisition Regulation (FAR). Mr. Tidemann was responsible for procurement and project controls development/monitoring during the later stages of the construction of an 11-story high-rise, 1,100-bed prison. He subsequently assisted with development of a comprehensive request for equitable adjustment valued at approximately $13 million for constructive changes and resultant delays.

Air Route Traffic Control Center, Anchorage, AK

Mr. Tidemann directed development of a comprehensive request for equitable adjustment valued at approximately $6 million for constructive changes, directed changes, acceleration and delays. He later provided expert testimony (relative to entitlement to damages, quantification of damages, and schedule analysis) in pre-trial deposition. The dispute settled in subsequent negotiations.

Tarrant County Jail, Tarrant County, TX

Mr. Tidemann directed development of a comprehensive request for equitable adjustment valued at $600,000 for changes and delays arising from defective/deficient design documents, and assisted with negotiations and settlement.

Street Improvements, Columbus, OH

Mr. Tidemann directed development of a comprehensive request for equitable adjustment values at $500,000 for changes and delays arising from defective/deficient design documents. He also assisted with negotiations and settlement and he provided expert testimony in mediation.

New Highway Construction, Two Rivers, WI

Mr. Tidemann directed development of a comprehensive request for equitable adjustment valued at $450,000 for changes and delays. He also assisted the client with negotiations and settlement.

Uranium Mill Tailings Remediation Project, Mexican Hat, UT

Project owner was the Department of Energy, and the contract was governed by the Defense Federal Acquisition Regulation. Mr. Tidemann co-directed the positioning of a contractor to self-terminate for convenience due to limitation of funding, and to convert the contract from a firm, fixed-price contract to a cost-reimbursable one. He also assisted with the identification, compilation, and presentation of actual costs incurred, supported the client during an audit by the Defense Contract Audit Agency (DCAA), and assisted with subsequent negotiations and settlement.

Metropolitan Transit Authority, Miami, FL

Mr. Tidemann assisted with quantification of damages incurred by the contractor, primarily due to latently defective/ deficient design documents, the owner’s actions and inactions, directed and constructive changes, and delays.

Cardinal States Gathering Line, KY and WV

For a project consisting of a shallow-bury, 30” diameter, 32-mile gas pipeline, Mr. Tidemann directed development of a comprehensive request for equitable adjustment valued at $1 million for differing site conditions, constructive changes, directed changes, acceleration, and delays. He also provided expert testimony (relative to entitlement to damages and quantification of damages) in pre-trial deposition. The dispute was ultimately settled via mediation.

Memphis-Shelby County Airport, Memphis, TN

For construction of a new airport runway, associated runways, and aprons, Mr. Tidemann directed development of a comprehensive request for equitable adjustment valued at $11 million for differing site conditions, constructive changes, directed changes, acceleration, and delays. He also provided support to the client’s legal counsel during arbitration conducted under AAA rules.

Heilig-Meyers Furniture Company Corporate Headquarters Building, Richmond, VA

Acting as Owner’s Representative on a dispute with the contractor concerning over-billing on a cost-plus contract, Mr. Tidemann performed comprehensive analysis of budgeted and actual costs, and provided expert testimony during formal arbitration conducted by AAA.
