Federal Government and FAR Related Projects
The following brief descriptions are select completed past projects and contain details about the efforts performed by Mr. Tidemann in connection with projects owned by some agency of the Federal government, and in connection with a claim, dispute, or litigation concerning the project.
Renovation of Army Barracks, Fort Wainwright, AK
Project owner was the US Army Corps of Engineers, and the contract was governed by the Federal Acquisition Regulation (FAR). Mr. Tidemann assisted with development of a comprehensive request for equitable adjustment valued at approximately $6 million for changes and delays. He was instrumental in the actual costs reconstruction and reclassification effort and subsequent identification/ quantification of the damages incurred. He also assisted with the research and development of individual entitlement issues.
Space Station Processing Facility, Kennedy Space Center, FL
Project owner was NASA, and the contract was governed by the Federal Acquisition Regulation (FAR). Mr. Tidemann directed development of a comprehensive request for equitable adjustment for the electrical subcontractor. The request, valued at $1 million, stemmed mainly from changes and delays arising from defective/ deficient design documents and the owner’s actions and inactions. Later, Mr. Tidemann assisted the contractor and its legal counsel with the development and presentation of a single issue in front of the Board of Contract Appeals.
Federal Detention Facility, Miami, FL
Project owner was the Federal Bureau of Prisons, and the contract was governed by the Federal Acquisition Regulation (FAR). Mr. Tidemann was responsible for procurement and project controls development/monitoring during the later stages of the construction of an 11-story high-rise, 1,100-bed prison. He subsequently assisted with development of a comprehensive request for equitable adjustment valued at approximately $13 million for constructive changes and resultant delays.
Air Route Traffic Control Center, Anchorage, AK
Mr. Tidemann directed development of a comprehensive request for equitable adjustment valued at approximately $6 million for constructive changes, directed changes, acceleration and delays. He later provided expert testimony (relative to entitlement to damages, quantification of damages, and schedule analysis) in pre-trial deposition. The dispute settled in subsequent negotiations.
Uranium Mill Tailings Remediation Project, Mexican Hat, UT
Project owner was the Department of Energy, and the contract was governed by the Defense Federal Acquisition Regulation. Mr. Tidemann co-directed the positioning of a contractor to self-terminate for convenience due to limitation of funding, and to convert the contract from a firm, fixed-price contract to a cost-reimbursable one. He also assisted with the identification, compilation, and presentation of actual costs incurred, supported the client during an audit by the Defense Contract Audit Agency (DCAA), and assisted with subsequent negotiations and settlement.
